It depends on the type of case. Personal physical injury settlements are generally tax-free under Section 104(a)(2) of the Internal Revenue Code. Most other settlements — discrimination, whistleblower, contract disputes, and more — are taxable income, and in many cases you can be taxed on the entire gross settlement, including the part paid to your attorney.
